Terms & conditions
Version 2026-10-draft
These terms apply to every purchase of an artwork on this website, whether at a fixed price (“Buy Now”) or in a timed online auction. Please read them before you buy or bid. By completing a purchase or placing a bid you accept these terms. You can save or print this page at any time.
1. Who we are
The seller is Anna Harsanyi-Zorandy (“we”, “us”). We sell artworks as a trader. Our full details are in the imprint:
- Name
- Anna Harsanyi-Zorandy
- Address
- Heggenstraat, 6211 GW Maastricht
- KVK (Chamber of Commerce)
- 82891605
2. Scope
- These terms apply to contracts concluded through this website with consumers and with business buyers.
- Where you buy as a consumer (for purposes outside your trade, business or profession), nothing in these terms limits the rights you have under mandatory consumer law.
- Descriptions, images and dimensions of works are given with care. Colours may differ slightly on screen.
3. Prices and payment
- All prices are in euro (EUR).
- We are not registered for VAT, so no VAT is charged on the price.
- Shipping costs are calculated for your destination country and shown separately before you pay (Buy Now), or before you register to bid and again when the auction is won (auction).
- Payments are processed by Stripe. We accept the payment methods shown at checkout (such as cards, Apple Pay and Google Pay). We never see or store your full card number.
4. Buying at a fixed price
- When you start checkout, the work is held for you for about 30 minutes so nobody else can buy it at the same time. If you leave or cancel checkout, the hold is released.
- The contract is concluded when you complete payment with the button that confirms your order with an obligation to pay. We confirm the purchase by email.
- With a delayed payment method (such as a SEPA bank debit), the work stays reserved until the payment has arrived. If the payment fails, the order is cancelled and the work becomes available again.
5. Online auctions
Our auctions are timed online auctions. They are not “public auctions” within the meaning of Article 2(13) of the Consumer Rights Directive (2011/83/EU), because you cannot attend in person. Your right of withdrawal therefore applies to works bought at auction too (see section 8).
- Registration. To bid, you register once with your name, email address and delivery address, and save a payment card with Stripe. Your card is not charged when you register.
- Starting bid and increments. Each auction has a starting bid and a minimum increment, shown on the work’s page. The first bid must be at least the starting bid; every later bid must be at least the current highest bid plus the minimum increment. You cannot outbid yourself while you are the highest bidder.
- Soft close. Each auction has an end time. If a bid is placed in the final 2 minutes, the end time moves to 2 minutes after that bid. This repeats until 2 minutes pass without a new bid. The countdown on the page shows the current end time; our server’s clock is decisive.
- Reserve price. A work may have a hidden minimum price (reserve). We do not disclose the amount; the page only shows whether the reserve has been met. If the auction ends with the reserve not met, or without bids, the work is not sold and no contract is concluded.
- Binding bids. Each bid is a binding offer to buy the work for the amount of your bid plus the shipping costs for your registered delivery country. A bid cannot be cancelled once placed. This does not affect your right of withdrawal after a contract has been concluded (section 8).
- Winning. When the auction ends, the highest bidder wins if the reserve (if any) is met. The contract is then concluded between the winner and us for the winning bid plus shipping. We inform the winner by email.
- Automatic payment. By registering, you authorise us to charge your saved card, without you being present, for the winning bid plus shipping when you win. We only charge your card if you win.
- Payment link fallback. If the automatic charge fails or your bank requires authentication, we email you a secure payment link, which is valid for 23 hours. If payment is not completed in time, we may send a new link or cancel the sale and offer the work again.
- Bid history. Bids are shown publicly under your anonymous paddle number for that auction (e.g. “Paddle 247”), never with your name.
- Changes. We may cancel an auction before it ends, for example if the work is damaged or there is a technical error. No contract is concluded in that case and no one is charged.
6. Shipping, duties and import taxes
- We ship to the countries offered at checkout. We do not ship to the United Kingdom. Some works are shipped on quotation only.
- Every work is professionally packed and shipped insured for its purchase price. Delivery times shown are estimates.
- The risk of loss or damage passes to you when you (or a person you name, other than the carrier) receive the work.
- Outside the European Union (including Switzerland and Norway), import duties, import VAT or sales tax and customs clearance fees may be charged by the destination country. These are not included in our prices or shipping costs and are payable by you.
- Please check the packaging on delivery and report visible damage to the carrier and to us straight away.
7. Ownership and copyright
- Ownership of the work passes to you when we have received full payment.
- Buying a work gives you the physical object. Copyright and other intellectual property rights remain with the artist. You may not reproduce the work commercially without written permission.
8. Right of withdrawal (14 days)
As a consumer you may withdraw from a purchase, at a fixed price or at auction, within 14 days after you receive the work, without giving a reason. You bear the direct cost of returning the work. Because artworks need specialist, insured packaging and transport, return costs can be substantial; as a guide, expect them to be about the same as the insured shipping cost of your order. Full details and the model withdrawal form are on our right of withdrawal page.
9. Conformity and complaints
- We guarantee that the work corresponds to its description. If it does not, you have the rights given by law (including repair, replacement, price reduction or termination). These statutory rights are not limited by these terms.
- Complaints can be sent to us by email at studio@annaharsanyi-zorandy.com. Please describe the problem clearly and, where possible, include photos. We acknowledge complaints promptly and aim to answer within 14 days.
- If we cannot resolve a complaint together, you may bring the dispute before the competent court (see section 11).
10. Liability
We are liable in accordance with the law. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including towards consumers.
11. Governing law and jurisdiction
- These terms and every contract under them are governed by Dutch law.
- If you are a consumer living in another country, this choice of law does not deprive you of the protection of the mandatory consumer law of your country of habitual residence (Article 6 of the Rome I Regulation).
- Disputes are submitted to the competent Dutch court. As a consumer you may also bring proceedings in the courts of the country where you live, and we can only sue you there.
12. Changes to these terms
We may update these terms. The version that applies to your purchase or bid is the one published when you placed your order or bid; its version is shown at the top of this page.
